CONDITIONS
Promoter/Data Controller: St Austell Brewery Company Ltd, 63 Trevarthian Road, St.Austell, Cornwall, PL25 4BY.
1. Promotion is open to residents of the United Kingdom who are aged 18 or over, except employees of the Promoter (St Austell Brewery Company) and their immediate family members or anyone professionally associated with this promotion.
2. Purchase and internet access are required.
3. Maximum one entry per person per day. Maximum one prize draw prize per person. Maximum one instant win prize per person.
4. Promotion Period: Daily between 11:00 and 23:00 between 1 July 2023 and 15 September 2023. Entries will not be accepted outside these hours.
5. To participate: During the Promotion Period purchase a pint of any Proper Job beer at any participating venue (where calls to action are posted) and receive a promotional coupon with a QR code and a unique code. Scan the QR code or access winaproperdayout.co.uk, pass the age gate then complete the online entry form with your name and email address and enter the unique code from your promotional coupon. Each unique code can only be used once.
6. Prize Draw Prizes: 3 x £1,400 Experience Days which must be redeemed within 1 year of date of issue. Winners have 5 options to select from:
a. Tickets for Sports Fanatics: A pair of tickets to a sports match of winner’s choice (subject to availability), to a maximum value £350 per person, including £50 travel allowance per person. In the event winner’s tickets are under £350 per person the winner will not receive the difference.
b. Flying Experience: One 60-minute flying lesson for one in a light aircraft at one of 3 sites, with one night accommodation (4 star, double or twin room, breakfast included), £50 per person towards meals, £50 travel allowance per person.
c. Off Road 4x4 Experience: Half day off-road 4x4 driving experience for 2 (sharing one vehicle) including instruction and hire of equipment at one of 10 sites, with one night accommodation (4 star, double or twin room, breakfast included), £50 travel allowance per person.
d. Foodie Experience: Half day cookery course for 2, on a theme or cuisine of your choice from a range, and available at cookery schools around the country. Including instruction ingredients and equipment hire, with one night accommodation (4 star, double or twin room, breakfast included), £50 per person towards meals, £50 travel allowance per person.
e. Hot Air Balloon Flight: Sightseeing hot air balloon flight over the countryside, sunset or sunrise. From a range of locations within the United Kingdom. Includes one night accommodation (4 star, double or twin room, breakfast included), £70 per person towards meals, £50 travel allowance per person. Maximum one prize draw prize per person.
7. Instant Win Prizes: there are 375 Instant Win prizes as follows:
a. 250 x £10 St Austell Proper Job vouchers – valid only at the St Austell website here for use against purchases of St Austell Proper Job. Must be redeemed fully within 12 months.
b. 125 x £20 Virgin Experience vouchers – to be redeemed within 1 year of date of issue, see terms here for more information.
8. Prizes are not transferrable and cannot be exchanged for cash. In the event of unforeseen circumstances, the Promoter reserves the right to substitute a prize, or part of a prize, for an alternative of equal or greater value.
9. It is the responsibility of the entrant to provide correct, up-to-date details when entering the promotion and on acceptance of their prize. The Promoter cannot be held responsible for winners failing to supply accurate information which affects prize acceptance or delivery of their prize.

11. Prize Draw winner selection and notification: All valid entries received by the Promoter during the Promotion Period will be submitted into a prize draw to be conducted by or under the supervision of an independent body within 5 working days of the end of the Promotion Period. The 3 winners and 2 reserves will be selected. The winners will be notified by email to the account associated with the winning entry within 5 working days of date of the winner selection. The winners must respond within 10 working days of the date of the notification email, confirming compliance with these Terms and Conditions and eligibility (age, residency) and provide a delivery address within the United Kingdom. Failure to comply with this timeframe may result in disqualification of that winner and the prize being awarded to a reserve selected in the same manner as described above. Entrants are encouraged to monitor their email account during this time in case they are a winner.
12. Unclaimed Prize Draw Prize: If despite the best efforts of the Promoter, a prize remains unclaimed after offering to 2 reserves, the Promoter shall not be obliged to allocate that prize but may withdraw it from the promotion.
13. Instant Win winner selection and notification: A set of 375 winning moments from throughout the Promotion Period have been randomly generated. Each winning moment has been randomly allocated an Instant Win prize. Entrants who submit their entry on or first after one of the winning moments will win the Instant Win Prize associated with that winning moment. If no one makes a valid entry between one winning moment and the next, the relevant Instant Win Prize will be rolled over and the oldest rolled over prize will be awarded to the next eligible entrant. Instant Win Prize Winners will be notified immediately on screen that they have won and will also receive an email. Vouchers will be sent by email to the account linked with the winning entry. All prizes will be sent within 30 days of the end of the Promotion Period.
14. A winner may be requested to participate in publicity arising from the promotion, though for regulatory reasons if a winner is or looks under 25 such publicity will not include photographs of the winners.
15. Privacy: The details you provide when entering this promotion, namely your email address, will be held by the Promoter under the terms of its privacy policy, available here. Your personal data will be used by the Promoter and its agents acting on their behalf only for the operation of this promotion. The Promoter is bound by the EU General Data Protection Regulation (GDPR) and the UK Data Protection Act 2018 and all applicable laws. Your personal data will be stored for 3 months after the end of the Promotion Period, after which it will be deleted. Your personal data will not be used to marketing purposes. You can request access to your personal data, or have any inaccuracies rectified, by sending an email to hello@winaproperdayout.co.uk. 16. The surnames and counties of residence of the Prize Draw Prize winners are available on request by sending an email to hello@winaproperdayout.co.uk with “Proper Day Out winners” in the header to arrive between 15 October and 15 December 2023. Entrants can object to disclosure, or request that disclosure be limited in scope by including this in their response to their win notification. In any case, if a regulatory body requests confirmation of the existence of winners, or evidence of receipt of prizes, the Promoter shall be entitled to disclose the information of any winner to the regulatory body only.
17. Participants in this promotion agree that neither the Promoter nor any of the promotional parties will have liability for: a. any faulty or failed electronic data transmissions; b. any communications line failure, regardless of cause, with regard to any equipment, systems, networks, lines, satellites, servers, computers, human error or providers utilised in any aspect of this Promotion; c. any inaccessibility or unavailability of the internet or email services; d. any damage to prizes sent to participants; e. any non-delivery of prizes caused by the provision of wrong information by participants, postal disputes or other causes beyond the Promoter’s control; or f. any system failures on the email services.
18. Insofar as permitted by law, the Promoters, its agents, and distributors will not in any circumstances be responsible or liable to compensate the winners or accept any liability for any loss, damage, personal injury or death occurring as a result of entering or taking up the Prize. Nothing in this clause shall limit the Promoter’s liability in respect of; (a) death or personal injury arising out of its own negligence; or (b) liability arising out of the Promoter’s fraud.
19. Entries (bulk or otherwise) made from trade, consumer groups or third parties will not be accepted. If it becomes apparent that a participant is using a computer(s) to circumvent this condition by, for example, the use of ‘script’, ‘brute force’, masking their identity by manipulating IP addresses, using identities other than their own or any other automated means in order to increase that participant’s entries into the draw in a way that is not consistent with the spirit of the promotion, that person’s entries will be disqualified and any prize award will be void.
20. The Promoters reserve the right to verify any claimant, including their age (via means of photographic identification), before awarding a Prize and refuse to award the Prize or withdraw Prize entitlement where there are reasonable grounds to believe there has been a breach of these terms and conditions or any instructions forming part of this promotion.
21. Incomplete, illegal, misdirected or invalid entries, or entries not in accordance with these Terms and Conditions will not be accepted. Proof of sending will not be accepted as proof of delivery. The Promoter takes no responsibility for entries delayed, incomplete or lost due to technical reasons or otherwise.

23. The Promoter has no control over internet or communication networks and is not liable for any problems associated with them due to traffic congestion, technical malfunction or otherwise. The Promoter will not be held liable to any individual for any fraud committed by any third party nor for any event beyond its control including, but not limited to, user error and any network, computer, hardware or software failures of any kind which may restrict, delay or prevent a participant’s entry to the promotion.
24. If any of these clauses should be determined to be illegal, invalid or otherwise unenforceable then it shall be severed and deleted from these Terms and Conditions and the remaining clauses shall survive and remain in full force and effect.
25. The Promoter’s decision is final with regard to all promotional matters and no correspondence will be entered into.
26. These terms and conditions are governed by the laws of England and Wales and shall be subject to the exclusive jurisdiction of the English and Welsh courts unless you live in another part of the United Kingdom, in which case your local courts will have jurisdiction.
